welcome to my web site
If you are a telemarketer, then here are some things you should know about me:
I do not want to receive telemarketing calls.
I do not have a dozen different telephone numbers.
I do not submit my cellular or landline telephone numbers to websites because I want telemarketers to call me.
If someone told you that they have some kind of "opt-in" information from me, then they are lying to you about that, and you should seriously consider what else they might be lying to you about.
The Telephone Consumer Protection Act (TCPA) prohibits various types of telemarketing, and it provides a Private Right of Action so that individuals can sue telemarketers who violate the TCPA.
If you are a telemarketer, then you should become familiar with the following information about the TCPA.
If you are receiving telemarketing calls that you think might be illegal, then you should become familiar with the following information about the TCPA.
The TCPA (47 USC 227) can be found here.
The FCC's rules regarding the TCPA (47 CFR 64.1200) can be found here and here.
Many of the FCC orders related to the TCPA can be found here.
The FCC has ruled multiple times that a party selling goods or services can be held liable for telemarketing calls that were made on their behalf by a third party telemarketer. An example of one such ruling can be found here.
Here are court decisions from some of my TCPA cases (both class-action lawsuits and individual lawsuits):
Abramson v. American Advisors Group (class settlement of $3,500,000.00)
Abramson v. Frontier Utilities Northeast (class settlement of $3,050.000.00)
Abramson v. Safe Streets USA (class settlement of $1,500,000.00)
